Black Widow Questions

Is it legal to anyone's knowledge about selling black widows? Like without a permit or something? Because I have an egg sac just hatched and another about to. I am a very experienced Tarantula and spider owner or I would not be doing this. I purchased my adult female black widows from reputable dealer with a shop online. I wasn't expecting egg sac but hey! It happened. I wonder if it is legal and or OK for me to post them as available on here? Thank you so much for reading. I'll check back.

Also if anyone else has raised them from egg sac can you hit me up?! I can post pictures too. But I'd love to hear from someone else too about how you separated and raised such dangerous little guys. I'm going off of very little information just my experience and a shop owners advice.

I'm not aware of any federal laws regarding black widows except that the U.S. Postal Service considers them nonmailable. You (and the buyer) would need to check for applicable state and municipal laws.

I shipped widows between two states, and the departments of agriculture and natural resources of both states did not care. They both said as long as you aren't shipping crop pests, there are no restrictions on shipping bugs. I only asked for two states, though, so you'd want to check with your state and the state you're shipping to, of you want to make sure you're doing everything by the book.

The only problem I ran into was finding a carrier that would ship them. Fedex is the only carrier that will ship spiders, but you are supposed to have a license through Fedex to ship live animals. From what I understood, the licenses are only for businesses or institutions, not private sellers. The two people working when I asked at Fedex told me to ship them, but not mention what's in the package. They don't xray packages, and their recommendation was to pack them well and not say anything.

Something to be aware of when shipping ANYTHING.
-USPS has it's own set of legal codes.
-Federal laws
-State laws
-Local ordinances.
It may be legal under three of the four jurisdictions and still be a criminal act.

Examples

Shipping black widows (invertebrates) is forbidden by USPS. It may be legal by Federal law, and is handled case by case on the state and local level.
Shipping certain invertebrates by a private shipping company may be legal by Federal and state laws but local ordinances forbid moving the animals into or out of quarantined areas.

In all cases, violation of any laws or ordinances by the shipper may (depending upon law enforcement agency interpretations) hold the receiver of the shipment complicit in the crime. Even if the person receiving the restricted goods has no criminal intent, the person may be complicit in the act.
A Complicity interpretation: If the receiver wasn't involved, the crime would have not taken place.

Know the laws, both the buyer and the seller.

Seems you have a lot to consider, perhaps consulting with an experienced seller in your state would help guide you as well.

I appreciate the responses, thanks to all. I do have a lot to consider and research on the matter. For now I think I will be keeping it local, just sitting on them.
