Yellow Jacket Nest

There is a yellow jacket sitting a small nest on my porch....I personally do not like yellow jackets cause well they will keep stinging you till you go away. But i was wondering if it could be a queen setting up a nest. The wasp doesn't look big at all but it is the only one i have seen around the nest.

Pics are mandatory in these situations. Just lleave it be for now. Once you post pics we can determine what you want to do, in the worst case kill the nest as it is very near a traffic area or since its small you can move it.
