Without a doubt, you need to notify the breeder of their mistake.

That being said, the morally right path will reveal itself in the conversation with the breeder.

If the breeder sold the spider, they were willing to part with it. If they would like it back, they might offer you a fair price but a reputable breeder should NEVER demand more money in my opinion. I wouldn't.

If I were the person you bought the spider from, I'd offer to pay for the shipping for the exchange but if you wanted to keep the female I wouldn't push it. I've done everything I could for customer service on my end and all that's left to do is kick myself for my stupid mistake.

If they want more money, you don't have to give it to them. Heck, its yours and you bought it. They can't demand it back or more money.

Really, I don't see why you should have to contact them unless you actaully WANTED a male. They know they make mistakes, and unless you want to just inform them of your discovery.

Legally, I have no doubt that you are correct. But legality and doing the right thing are not necessarily the same.

I've sold a spider before as a male and it later turned out to be female. I never once thought of asking for the spider back, more money, etc. It was my mistake - not the buyer's.

I did want the male for breeding.......... however I am really not to upset because what harm could another female in the project be?

It was not a board member.... Lol I would not have even posted this if it was a board member.

I think Ill just keep her, this kinda makes up for all the times I have gotten males when I bought females, or bought unsexed slings and they all were males.

Maybe I am a bad person for it, But hey karma right? lol.....

I've had this happen many times and I usually tell them so that they won't make the same mistake twice.

Personally I only buy males for breeding purposes anyway so I usually contact the seller and request a male and send back the female.

I also feel that you should tell the seller though because they might of made a mistake and didn't realize it until after the fact.

It's really more of an ethics situation than anything.

You really should tell them. You have the T, they can not make you give her back, you legally purchased her. It was their mistake. Let them know so they don't make the mistake with someone else as well.
