First of all I am interested in learning if this is in fact a queen? And 2nd if possible to ID from these bad pics

That's awesome, seemed different so I assume it could be, would be my first colony tho

Most ants lose their wings after mating, but they can lay eggs and eventually lose their wings. There is a chance that it could not have mated.

Yeah was wondering about that aswell, I can try and if nothing happens I will deff release her, any idea to a which sp or familiy it could be? It's deff local (Serbia/Balkan)

EDIT: Looks alot like Lasius niger

I don't think it is a Lasius Niger because Lasius Niger queens have fat abdomens. The is a helpful link: http://www.antwiki.org/wiki/Serbia it shows most of the ant species in Serbia. It will be much easier to tell what species when the queen has made her workers.
